The Disaster of ERISA

As longtime users of TP (which all of you out there should be, dirty birdies) are no doubt aware, ERISA is a favorite subject here. There are two extremely important cases relating to ERISA (for you health lawyers out there, no pun intended on 'relating to') at the Supreme Court right now.

Unfunded Mandates

One of my major beefs about the American health care system is that legislatures, both state and federal, often adopt piecemeal approaches to the problem, which is so layered and multifaceted that any narrow approach is doomed from the outset, and, according to the law of unintended consequences, or complexity theory, often results in, well, unintended consequences.
